1.1 Please read these General Terms and Conditions carefully.
Upon completion of the registration process, Advantage Consulting, s.r.o., with its registered office at Orlí 708/36, Brno-město, 602 00 Brno, Czech Republic, Company ID No.: 26289822, AC Jobs, s.r.o., with its registered office at Orlí 708/36, Brno-město, 602 00 Brno, Czech Republic, Company ID No.: 26962985, THEONES.CZ, s.r.o., with its registered office at Orlí 708/36, Brno-město, 602 00 Brno, Czech Republic, Company ID No.: 14105586, smitio.com s.r.o., with its registered office at Orlí 708/36, Brno-město, 602 00 Brno, Czech Republic, Company ID No.: 11967471, together with other companies participating in employment placement services, the complete list of which is available here (hereinafter referred to as the "Controllers"), shall grant you full access to the website www.acjobs.cz and the website acjobs.mycapax.com (hereinafter referred to as the "Website") for the purpose of assisting you with the recruitment process and any other professional services provided by the Controllers which you choose to use.
1.2 Please note that these General Terms and Conditions shall also apply in full if you decide not to register and are granted only limited access.
1.3 Please note that these General Terms and Conditions may be updated from time to time as necessary. By continuing to use the Website, you shall be deemed to have accepted any such amendments.
2. Security and Use of Username and Password
2.1 In order to register on the Website, you are required to create a username and password, which you will use each time you log in to the Website.
2.2 You are solely responsible for the use and protection of your username and password. The Controllers shall not accept any liability whatsoever for any unauthorized or improper use of these credentials or for their disclosure.
2.3 If you believe that your username and/or password may have been disclosed in any way, please use the relevant link available on the Website to reset your credentials.
3. Rules for the Use of the Website
3.1 The Website must not be used to publish any materials or links that:
3.1.1 Are intentionally false, inaccurate, or otherwise misleading.
3.1.2 Infringe copyright, intellectual property rights, image rights, privacy rights, or personal data protection rights of any third party.
3.1.3 Are offensive, threatening, obscene, or may reasonably be interpreted by the Controllers or third parties as inappropriate or damaging to public order or to the good reputation of the Controllers.
3.1.4 May be considered defamatory under the applicable jurisdiction.
3.1.5 May incite violence or other criminal offences or give rise to civil liability.
3.1.6 Infect the Website with viruses, malware, bloatware, or any other type of software that interferes with the proper operation of the Website or alters its content in any manner not permitted under these General Terms and Conditions.
3.1.7 Require a licence or formal consent for publication where such consent has not been obtained.
3.2 The Controllers shall have the sole right to determine whether any published material complies with the above rules. If the Controllers consider that such material does not comply, they may, without prior notice, prevent you from further using the Website or terminate your registration on the Website and remove any material that does not comply with these General Terms and Conditions. The Controllers shall not be obliged to provide any justification for such actions.
3.3 Where required by law, the Controllers shall fully cooperate with the police, security authorities, and any other competent authorities in identifying any person who has breached these rules.
4. Intellectual Property Rights
4.1 Unless expressly stated otherwise, all copyrights and intellectual property rights relating to all content available on the Website are owned by the Controllers or their licensors.
4.2 You are not permitted to download, copy, or otherwise reproduce any content unless it is intended solely for your personal use or unless downloading such content is expressly permitted. In all cases, you must continue to comply with all applicable copyright and/or intellectual property rights.
4.3 You are prohibited from attempting to modify, decompile, decipher, reverse engineer, or otherwise interfere with any software, source code, or other information contained on the Website.
5. Availability of and Changes to the Website
5.1 Every reasonable effort is made to maintain the Website in full and continuous operation. However, interruptions may occasionally occur due to maintenance, content updates, or technical issues. The Controllers shall not accept any liability or responsibility for such interruptions or unavailability.
5.2 The Website, its functionality, and/or its content may be modified, suspended, or discontinued at any time without prior notice.
6. Links to Other Websites
6.1 In order to expand the services provided and to offer labour market information, the Website may contain links to third-party websites. The Controllers accept no responsibility or liability whatsoever for the content of any third-party websites. Accessing such websites is entirely at your own risk.
6.2 If you wish to place a link to the Website, you are requested to first notify the Controllers by sending the relevant link to info@acjobs.cz. The Controllers reserve the right to refuse permission to any third party to publish a link to any part of the Website, to withdraw any previously granted permission without prior notice, and shall not be obliged to provide any explanation for such decision.
6.3 For the purpose of better understanding your needs and providing improved recruitment services, aggregated statistical and other information concerning visitors to the Website may be collected and shared with selected third parties. Such information may include data provided by you; however, no specific names or personally identifiable information will be disclosed. Any personal data shall be processed in accordance with the Personal Data Processing Policy.
7. Termination
7.1 The Controllers may, at any time and at their sole discretion, deny you access to or terminate your registration on the Website without being required to provide any explanation.
8. Representations and Warranties
8.1 The Controllers do not warrant or guarantee that you will be successful in obtaining employment or that you will be considered by any client for any position.
8.2 The Controllers make no representations or warranties whatsoever regarding the terms and conditions of any employment that may be offered to you by a client.
8.3 The Controllers cannot guarantee that clients will maintain the confidentiality of any personal data relating to candidates provided to them. Nevertheless, the Controllers shall make every reasonable effort to ensure that such confidentiality is maintained.
8.4 The Controllers shall use all reasonable efforts to ensure that the information published on the Website, including labour market information and salary data, is as accurate as possible. However, the Controllers make no representations or warranties regarding the accuracy or completeness of such information, and all express or implied warranties are hereby excluded.
The Controllers shall not be liable for any loss or damage of any kind, including indirect or consequential damages, arising from any person's or entity's reliance upon such information, except where such liability cannot be excluded or limited under applicable law.
9. Candidate Declaration
9.1 As a Candidate:
9.1.1 You agree to fully comply with these General Terms and Conditions governing the use of the Website.
9.1.2 You acknowledge and accept the Controllers' right, at their sole discretion, to suspend your access to or terminate your registration if you fail to comply with these General Terms and Conditions.
9.1.3 You acknowledge and accept that, although the Controllers use their best efforts to find suitable employment opportunities for you, they do not guarantee that you will be considered for any position, invited to an interview, or offered employment or an employment contract. You hereby waive any claims against the Controllers arising from any loss or damage of any kind that may result in this respect.
9.1.4 You acknowledge and accept that the Controllers provide no warranties regarding the duration or terms of any employment relationship established as a result of your use of the Website. You hereby waive any claims against the Controllers arising from any loss or damage of any kind that may result in this respect.
9.1.5 You acknowledge that, for the purpose of seeking employment on your behalf, the Controllers may, at their sole discretion, submit your personal data to clients and may display some or all of your personal data on the Website in accordance with the Personal Data Processing Policy.
9.1.6 You understand and acknowledge that your current employer may gain access to clients and to the Website through other channels. You hereby waive any claims against the Controllers arising from any loss or damage of any kind that may result in this respect.
9.1.7 You fully indemnify the Controllers against all costs, claims, liabilities, damages, expenses, or legal proceedings arising out of your use or misuse of the Website.
9.1.8 You acknowledge that you are obliged to inform the Controllers without undue delay if you commence employment with an employer recommended by the Controllers, either by e-mail or by telephone to the HR Consultant with whom you have been communicating.
10. Client Declaration
10.1 As a Client:
10.1.1 You agree to fully comply with these General Terms and Conditions governing the use of the Website.
10.1.2 You acknowledge and accept the Controllers' right, at their sole discretion, to suspend your access to or terminate your registration if you fail to comply with these General Terms and Conditions.
10.1.3 You agree to treat all candidate data received from the Controllers through the Website or by any other means as strictly confidential and to process such data in full compliance with all obligations imposed upon data controllers, in particular pursuant to Act No. 110/2019 Coll., on the Processing of Personal Data and on Amendments to Certain Acts, as amended, and Regulation (EU) 2016/679 of the European Parliament and of the Council (General Data Protection Regulation – GDPR).
10.1.4 You agree to use candidate data received from the Controllers through the Website or by any other means solely for the purpose of identifying candidates for vacant positions.
10.1.5 You agree not to disclose candidate data to any third party unless the candidate has provided consent in accordance with the General Data Protection Regulation (GDPR).
10.1.6 You represent and warrant that all materials provided to the Controllers:
i. shall not infringe the copyright or any other intellectual property rights of third parties;
ii. shall not infringe the rights relating to personal likeness or privacy pursuant to Sections 84 et seq. of the Czech Civil Code;
iii. shall not contain personal data within the meaning of the General Data Protection Regulation, except as provided in Clause 10.1.7.
10.1.7 Where the materials provided contain personal data, you undertake to conclude a data processing agreement with the Controllers pursuant to Article 28 of the General Data Protection Regulation before providing such materials to the Controllers.
10.1.8 You undertake, without undue delay and upon written request of the Controllers, to demonstrate compliance with the obligations set out in Clauses 10.1.3, 10.1.4 and 10.1.6.
10.1.9 You shall be fully responsible for any infringement of third-party rights. Should any third party assert any claim in relation to the materials provided, you undertake to compensate the Controllers for any loss or damage thereby incurred, including all costs reasonably incurred in defending the Controllers' rights, and to provide the Controllers with all necessary cooperation at your own expense. Where any administrative or similar proceedings are initiated against the Controllers in connection with the use, processing, or other handling of the materials provided, including the imposition of any public law sanction, you undertake to compensate the Controllers for all resulting loss or damage, reimburse all costs incurred in defending the Controllers' rights, and provide the Controllers with all necessary cooperation at your own expense.
10.1.10 To the fullest extent permitted by applicable law, you fully indemnify and hold the Controllers harmless against any claims arising as a result of your breach of the above obligations.
11. General Terms and Conditions for Clients
11.1 In cases where the Controllers introduce a candidate to a Client for any type of employment or recruitment service, the General Terms and Conditions for Clients shall apply. These General Terms and Conditions shall be provided directly to the Client prior to the introduction of any candidate.
12. Severability
12.1 Should any provision of these General Terms and Conditions become invalid, illegal, or unenforceable, such invalidity, illegality, or unenforceability shall not affect the validity and enforceability of the remaining provisions, which shall remain in full force and effect.
13. Cookies
The Website uses cookies to improve the user experience. By enabling cookies, the Website is able to remember you together with your individual settings and preferences.
